1. Introduction and Acceptance

Welcome to The Wee Hive. These Terms of Service ("Terms") constitute a legal agreement between you and The Wee Hive ("we," "us," or "our") governing your use of our website at theweehive.co.uk and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

The Wee Hive is a marketplace platform that connects parents and families with children's activity providers, classes, events, and family-friendly businesses across Scotland. We provide:

  • A searchable directory of children's classes and activities
  • Information about family-friendly events and businesses
  • A platform for activity providers to list and manage their offerings
  • Communication tools to help families discover and connect with providers

3. Eligibility and Accounts

3.1 Age Requirements

  • Parents/Users: You must be at least 16 years old to create an account
  • Activity Providers: You must be at least 18 years old and authorized to represent your business

3.2 Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

3.3 Account Types

Parent/User Accounts: Free accounts that allow you to search, save preferences, and receive updates about classes and events.

Provider Accounts: Business accounts for activity providers, subject to subscription fees and approval processes.

4. Terms for Parents and Users

4.1 Your Rights

You have the right to:

  • Search and browse activity listings
  • Save your preferences and receive personalized recommendations
  • Contact providers directly through information displayed on their listings
  • Subscribe to our newsletter and updates

4.2 Your Responsibilities

You agree not to:

  • Use automated systems to scrape or download data from our platform
  • Misuse provider contact information for spam or harassment
  • Post false reviews or misleading information
  • Attempt to circumvent our security measures

4.3 Booking and Attendance

The Wee Hive is a directory service only. We do not process bookings or payments for classes and activities. When you contact a provider:

  • You form a direct relationship with that provider
  • All bookings, payments, and attendance arrangements are between you and the provider
  • We are not responsible for the quality, safety, or delivery of services
  • Any disputes should be resolved directly with the provider

5. Terms for Activity Providers

5.1 Listing Requirements

To list your activities on The Wee Hive, you must:

  • Operate a legitimate business providing children's activities or family services
  • Have appropriate insurance coverage for your activities
  • Comply with all applicable laws, including child safety regulations
  • Provide accurate and truthful information about your services
  • Maintain current and up-to-date class information

5.2 Approval Process

All provider accounts and activity listings are subject to our approval process. We reserve the right to:

  • Review all listings before they appear on the platform
  • Request additional information or verification
  • Reject or remove listings that do not meet our standards
  • Suspend or terminate accounts for policy violations

5.3 Subscription and Payment Terms

Free Trial: New provider accounts receive a 30-day free trial period.

Paid Subscriptions: After the trial period, access to certain features requires a paid subscription:

  • Subscription fees are charged monthly in advance via Stripe
  • Prices are displayed clearly during signup and available on request
  • You authorize us to charge your payment method automatically
  • You can cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused trial periods

5.4 Content License

When you submit content to The Wee Hive (descriptions, images, schedules), you grant us:

  • A worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
  • The right to feature your listings in search results, newsletters, and marketing materials
  • The right to modify formatting for consistency and display purposes

You retain ownership of your content and can remove it by deleting your listing or account.

5.5 Provider Responsibilities

As a provider, you are solely responsible for:

  • The accuracy of information in your listings
  • The quality and safety of your services
  • Managing bookings and communications with customers
  • Processing payments from customers
  • Handling customer complaints and disputes
  • Maintaining appropriate insurance and licenses
  • Complying with child safety and safeguarding requirements

6. Prohibited Activities

You must not use the Service to:

  • Post false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Harass, abuse, or harm others
  • Collect user information without consent
  • Interfere with the operation of the Service
  • Attempt unauthorized access to our systems
  • Use the Service for any commercial purpose without our permission

7. Content Moderation

We reserve the right to:

  • Monitor content posted on our platform
  • Remove content that violates these Terms
  • Suspend or terminate accounts for policy violations
  • Report illegal activity to appropriate authorities

We are not obligated to monitor content but may do so at our discretion.

8. Intellectual Property

8.1 Our Rights

The Service and all content, features, and functionality (including but not limited to design, text, graphics, logos, and software) are owned by The Wee Hive and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal or business purposes in accordance with these Terms.

8.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of our content
  • Reverse engineer or decompile any part of the Service
  • Use our trademarks or branding without permission
  • Frame or mirror any part of the Service

9. Disclaimers and Limitations of Liability

9.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantee of Accuracy

We do not guarantee that:

  • Information provided by activity providers is accurate or complete
  • The Service will be uninterrupted or error-free
  • Any defects will be corrected
  • The Service is free from viruses or harmful components

9.3 Limitation of Liability

To the fullest extent permitted by law, The Wee Hive shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage arising from your use of the Service
  • Actions or omissions of activity providers or other users

Our maximum liability to you for any claims arising from your use of the Service shall not exceed the greater of: (a) the amount you paid us in the 3 months preceding the claim, or (b) £100.

9.4 Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded by UK law

10. Indemnification

You agree to indemnify, defend, and hold harmless The Wee Hive, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service

You may stop using the Service and delete your account at any time by:

Upon termination:

  • Your right to use the Service ceases immediately
  • Your listings will be removed from the platform
  • Your account data will be deleted within 30 days (see our Privacy Policy)
  • Sections of these Terms that should survive termination will remain in effect

12. Changes to Terms

We may modify these Terms at any time by posting the updated Terms on this page with a new "Last Updated" date. Material changes will be notified via:

  • Email to your registered address
  • Prominent notice on our website

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13.2 Governing Law

These Terms are governed by and construed in accordance with the laws of Scotland and England, without regard to conflict of law principles.

13.3 Jurisdiction

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Scotland or England, and you consent to the jurisdiction of such courts.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and The Wee Hive regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 No Agency

Nothing in these Terms creates a partnership, agency, employment, or joint venture relationship between you and The Wee Hive.
